• Access Keys

  Most Web browsers offer an alternative way of following navigation links by using keyboard access keys. To use an access key when using Windows, hold down the Alt key and press the appropriate access key. For Macintosh users, hold down the Control key and press the appropriate access key. Internet Explorer may require you to use the Enter key to activate the link. To return to the home page, the access key is Alt+1.

   

  All links throughout SHAW.ca use the first letter of the link as its access key. As an example, pressing Alt+A activates the link to the About Us section. If a page has multiple links starting with the same letter, you can move through the available options by holding down the Alt key while pressing the access letter key.

  By using any of Shaw's services*, including its cable, Internet and/or digital phone services and any related services (collectively or individually, the "Services") provided by any of Shaw Cablesystems G.P., Shaw Telecom G.P. or its or theirpartners and/or associates (collectively, "Shaw"), you agree to the following terms and conditions of service (the "Terms of Service"):

  These Terms of Service constitute the understanding between Shaw ("Shaw" or "our") and the customer ("you" or "your") subscribing to all or any of the Services. These Terms of Service govern the Services and any devices and/or equipment, including, without limitation, ethernet devices, digital cable terminals, digital video recorders and software used in conjunction with the Services ("Equipment"). You acknowledge that the Equipment may be purchased by you and become Your Equipment (as defined in Section 5.6) or be provided to you by Shaw under a rental arrangement, in which case the Equipment shall be herein referred to as the "Rental Equipment". By activating the Services, you acknowledge that you have read, understand and agree to these Terms of Service as set out below. Shaw recommends that you print a copy of these Terms of Service and the Acceptable Use Policy applicable to the Services to which you subscribe. If you are not an Internet service subscriber you may contact Shaw at any time to obtain a printed copy of these Terms of Service.
  
  If you do not wish to be bound by these Terms of Service or any modifications which may be made by Shaw from time to time (as described in the following paragraph) do not activate or use the Services and immediately contact Shaw.

  In addition to the terms contained in these Terms of Service, these Terms of Service are also subject to the terms and conditions set out in the Shaw Acceptable Use Policy applicable to the Services, and available at www.shaw.ca.or as may be required by statute or regulation.
  
  YOUR NONTERMINATION OR CONTINUED USE OF THE SERVICES AFTER THE EFFECTIVE DATE OF ANY CHANGES MADE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF SERVICE AS MODIFIED BY SUCH CHANGES.
  
  In addition to the terms contained in these Terms of Service, these Terms of Service are also subject to the terms and conditions of Shaw's Acceptable Use Policies found at www.shaw.ca applicable to the Services or as may be required by statute or regulation.
  
  The customer can obtain more information about the Services and these Terms of Service by contacting Shaw's customer services at the telephone number(s) shown on the front of your billing invoice or on-line at www.shaw.ca.You may also contact Shaw through Shaw's local branches listed in the Contact Us section on Shaw's web site at www.shaw.ca or the telephone directory.

  
  *The details of the various Services packages, including other products and services offered by Shaw, can be found on our web site at www.shaw.ca. Shaw may, at its discretion, make changes to the Services from time to time, including changing Services fees or the sequence of Cable Services, introduce and/or substitute new basic and tier packages of Cable Services and change the Services in and prices of existing packages of Cable Services. 

• Use of the Services
  1. The Services may only be used in accordance with the Shaw Acceptable Use Policy applicable to such Services.
  2. The Rental Equipment, technology and/or processes provided to you may be subject to intellectual property rights reserved by Shaw or third parties. Nothing contained in these Terms of Service shall grant to you any right, license, title or ownership of, inor to any intellectual property rights of Shaw or any third party in such Rental Equipment, technology or processes.
  3. Shaw, the Shaw logo and certain product or service names are registered trade-marks or trade-marks of Shaw Cablesystems G.P. You agree not to copy, display or use in any manner any of Shaw's trade-marks without Shaw's express prior permission. Other product, information or company names mentioned herein may be the registered trade-marks or trade-marks of their respective owners.
  4. Federal law provides severe civil and criminal penalties for the unauthorized reproduction, distribution or exhibition of copyrighted motion pictures and certain programming and Shaw shall not be liable for the same, nor is Shaw granting you any rights in that regard whatsoever.

   
• Content
  Shaw does not warrant the condition or content of any programming you are able to view with Shaw's Cable Services or the content you are able to access on the Internet through the use of Shaw Internet Services. You acknowledge that there may be programming content or other content that you may find offensive and you agree that your viewing and/or use of such content is at your own risk. Some programming and/or content may not be suitable for minors and you agree to supervise all minors whom you permit to view the programming and/or access the content from Internet through your account with Shaw.
• Service Interruption/Shaw's Right of Entry
  1. Shaw and/or its agents may interrupt and/or inspect the Rental Equipment and/or the Services at any time for any duration of time, without notice or liability to you in order to install, inspect, repair, replace orperform necessary maintenance on the Rental Equipment, its facilities and/or network, or for other technical reasons as may be required.
  2. You agree to provide Shaw access to the Rental Equipment (including reasonable access to the location the Services are provided ("Service Location") as may be reasonably necessary under the circumstances. Shaw's employees/agents will show identification prior to entering the Service Location. Shaw is only required to provide you reasonable notice if Shaw needs access inside the Service Location. If you are not the owner of the Service Location, it is your responsibility to obtain and maintain access rights for the purpose of enabling Shaw employees and/or agents to install, maintain and provide the Services at such Service Location.
  3. You understand that the Services do not function in the event of a power failure and regardless of where the power failure arises. In addition, a power failure or disruption may require Shaw to reset or reconfigure the Rental Equipment, its facilities and/or network to reactivate the Services.
     
     IMPORTANT:
     Shaw does not warrant uninterrupted use of the Services.

   
• Equipment Installation, Maintenance and Return Responsibilities
  1. Shaw may install or cause to be installed the Rental Equipment in the Service Location. The Rental Equipment is provided solely for your use of the Services and will at all times remain the property of Shaw. You will not sell, lease, transfer or assign the Rental Equipment. You may use the Rental Equipment only at the Service Locaiton address you have indicated to Shaw at the time you subscribe to the Services. You will not re-arrange, disconnect, remove, repair or otherwise interfere with the Rental Equipment nor will you relocate the Rental Equipment to another address without Shaw's prior written consent.
  2. Rental Equipmentprovided by Shaw will be chargedas part of the monthly Services fee. Shaw may require you to pay a Rental Equipment deposit prior to providing you with the Rental Equipment. You agree to keep all of the Rental Equipment free and clear of any lien or encumbrance of any kind whatsoever. If you become aware that any lien or encumbrance has been placed on the Equipment you are responsible to notify Shaw immediately and to assist Shaw in removing same.
  3. You are responsible for the safekeeping of the Rental Equipment. If, while in your care, the Rental Equipment is damaged, lost or stolen you agree to pay Shaw the full cost, including the costs incurred by Shaw to recover, repair and/or replace the Rental Equipment. You hereby authorize Shaw to charge your credit card account or your preauthorized payment authorization, in payment for all RentalEquipment charges.
  4. Any unauthorized attachments to the Rental Equipment or interfering or tampering with the Rental Equipment or unauthorized use of the RentalEquipment are prohibited and may constitute theft under the Criminal Code of Canada.
  5. On the expiration or earlier termination of the Services you are required to return the Rental Equipment to Shaw in good working order. The Rental Equipment may be returned to any Shaw retail office. For information respecting a Shaw office near you and to arrange return of Rental Equipment contact Shaw's customer service either on-line at www.shaw.ca or by phone at 1 (888) 472-2222.If upon the expiration or earlier termination of the Services the Rental Equipment has not been returned to Shaw you agree to grant Shaw permission to access the Service Location to remove the RentalEquipment. Failure by Shaw to remove such Rental Equipment shall not be considered abandonment of the Rental Equipment. If Shaw removes the Rental Equipment it will not, nor is it required, to alter, repair or re-install wiring or other facilities. In the event that the Rental Equipment is not returned, or Shaw is unable to remove the Rental Equipment, you hereby authorize Shaw to charge your credit card account or your preauthorized payment authorization, in payment for the replacement cost of the Rental Equipment.
  6. 6. All Equipment and devices purchased and paid for by you, which are neither returnable to nor refundable by Shaw, and that you are required to supply for access and use of the Services or that you use in connection with the Services, such as hearing devices, telephones, home security and/or medical devices, fax machines, computer equipment or any other equipment and/or associated devices (collectively, "Your Equipment") shall be and remain your responsibility. You agree that Shaw is not responsible for any damage or loss to Your Equipment arising from your use of the Services. You further acknowledge and agree that Shaw is not responsible for the installation, operation, maintenance, use or support of Your Equipment, including without limitation, the compatibility of Your Equipment with any Rental Equipment or the Services.
  7. You are responsible to supply at your cost all telephones required if you subscribe to the Shaw Digital Phone Services, including the supply of all wiring inside the Service Location, needed to connect to the Services. Shaw has no obligation to maintain or repair any facilities or equipment owned by you.

   
• Payment Terms
  1. You agree to pay Shaw the total charges for use of the Services, including, without limitation: fees applicable to installation; Rental Equipment rental, deposits, or non-return charges; processing fees, costs incurred by Shaw and interest charges, if your account is past due; service calls; toll or long distance uses; calling cards; directory assistance uses; pay-per-view; video on demand uses; plus any applicable federal, provincial or regulatory taxes or surcharges, incurred in connection with the use of the Services (as all such fees may be changed from time to time). Shaw will bill you each month in advance for the services (usage based Services will be billed in arrears).
  2. You agree to pay all amounts by the due date indicated on your invoice by using any of the payment methods accepted by Shaw. Payments made after the statement date on your invoice will be reflected on your next invoice. Amounts owing after the due date are subject to a late payment interest charge calculated on the outstanding amount at 2% per month (26.8% per year) until paid in full. If your account remains unpaid for 60 days you agree to pay a processing fee of $20.00 for services relating to down-grading or terminating your Services. Overdue accounts are subject to termination of the Services by Shaw. You agree to pay Shaw $25.00 if your credit card is denied or if your cheque is returned due to non-sufficient funds. Payment of the full amount due will be required before the Services may be restored, provided Shaw is not under any obligation to restore the Services to any person who continues to fail to make timely payment of the amounts due or abuses Shaw's Acceptable Use Policy applicable to the Services.
  3. You are responsible to ensure that the billing information you provide Shaw is accurate. You agree to promptly notify Shaw of any changes in your billing information.
  4. You are responsible for any costs, including legal fees and expenses, collection agency fees or payments and Court costs incurred by Shaw to collect any amounts owing under these Terms of Service.
  5. If you are receiving the Services through a trial period offer, you agree that upon the expiry of such trial period, you will be bound by the payment requirements set out in this Section unless the Services are terminated in a manner set out in Section 10 below prior to the end of such trial period.
  6. You must bring billing invoice questions and disputes to Shaw's attention within 60 days of the invoice date. Your failure to contact Shaw regarding any invoice will constitute your acceptance of the invoice.

   
• Credit and Security Deposit
  Shaw reserves the right to examine your credit records at any time, whether before or after providing you the Services.
• Shaw's Provision of Services

  Shaw is not required to provide the Services where:

  1. the Service Location is located outside of Shaw's service or licensed geographic area;
  2. you have failed to make payment of the amounts due for the Services and/or the Rental Equipment; or
  3. Shaw would have to incur unusual expenses to bring the Services to the Service Location, which you do not agree to pay.

   
• If You are Moving
  If you are moving you are responsible to notify Shaw at least 30 days prior to the date you are moving. If you move to a location that is outside of the area served by Shaw, these Terms of Service shall be terminated and you must return all Rental Equipment to Shaw. If you are a Shaw Digital Phone subscriber and you move to a new location within Shaw's serving area and you wish to transfer the Shaw Digital Phone Services, including your current telephone number to the new premises, you must give Shaw a minimum of 15 calendar days advance notice. For Shaw Digital Phone Services, you may only transfer your telephone number within the same exchange area. The ability to transfer the Services to a new location is dependant on the availability of the Services at the new location.
• Customer-Initiated Termination
  1. You may terminate the Services for any reason at any time by providing Shaw no less than 30 days advance notice of your desire to terminate. Applicable Service charges continue to apply until the later of (1) the end of the notice period, or (2) such time as the Services are no longer accessible.
  2. You agree that if the Services are terminated for any reason you will:
     1. pay Shaw in full any amounts due and outstanding for your use of the Services and return the Rental Equipment to Shaw; and
     2. permit Shaw to access the Service Location at a mutually agreed upon time to remove the Rental Equipment and any other equipment ormaterials provided by Shaw if you fail to return same to Shaw as required under these Terms of Service.
      

   
• Shaw-Initiated Termination or Suspension
  1. Shaw may restrict, block, suspend or terminate all or any part of the Services immediately where you:
     1. fail to make timely payment on your account for the Services and such failure continues for more than 60 days;
     2. become bankrupt or otherwise insolvent;
     3. fail to provide Shaw with reasonable entry and access to install, inspect, repair, replace or to perform necessary maintenance on the Rental Equipment, or Shaw's facilities or network;
     4. are in breach of any term or condition of these Terms of Service or of Shaw's Acceptable Use Policy applicable to the Services that you subscribe to; or
     5. if you relocate, alter, abuse or disconnect the Rental Equipment.
      
  2. For the situations listed above, Shaw will attempt to notify you using the information shown on your account stating the reason and date scheduled for the suspension or termination.
  3. Despitethe above, Shaw will not provide you notice of a proposed restriction, block,suspension or termination:
     1. if immediate action must be taken to protect Shaw's facilities, Rental Equipment, or network, or if suspension is required by legal requirement, court order, ordinance or regulatory authority;
     2. if Shaw believes that extreme circumstances exist, or that there is an abnormal risk of loss involved in delaying the suspension or termination;
     3. if you misuse or abuse or permit others to misuse or abuse the Services for purposes that are contrary to law, these Terms of Service or Shaw's Acceptable Use Policy applicable to the Services you subscribe to; or
     4. in an emergency situation.
      
  4. if all or any part of the Services are restricted, blocked,suspended or terminated for cause, Shaw is not obligated to restore the Services. If Shaw agrees to restore your Services, a reconnection service charge may be applied. If you are a Shaw Digital Phone subscriber, Shaw cannot guarantee the availability or resumption of any previous telephone numbers following a suspension or termination of the Services.

   
• Shaw's Liability
  1. Shaw shall not be liable for:
  1. any interruption or unavailability of the Services, including, without limitation, any interruption or unavailability of emergency 9-1-1 service;
  2. any act or omission of any third party including, but not limited to, any other local telephone company, any connecting carrier or underlying carrier or other provider of connections, facilities or services;
  3. your conduct, acts or omissions;
  4. any event beyond the reasonable control of Shaw including acts of God, inclement weather (including lightning), power failures, labour disputes, riots or civil disputes, war or armed conflict, any law, governmental order, decision or regulation, or order of any court of competent jurisdiction;
  5. Shaw's failure, for any reason, to activate the Services on the activation date you requested or date provided to you by Shaw;
  6. any defacement of, or damage to, the Service Location resulting from the attachment of any instruments, apparatus or associated wiring and/or the Rental Equipment furnished by Shaw, or removal thereof, when such defacement or damage is not wholly caused by Shaw's negligence; and
  7. any damages you incur as a result of the operation or failure of Your Equipment, facilities, wiring or other devices you use with the Services, including without limitation if any of Your Equipment, facilities, wiring or other devices that you use with the Services are now or later become incompatible with the Rental Equipment and/or the Services.

   
• Limitation of Liability
  1. IN THE EVENT OF ANY BREACH BY SHAW,INCLUDING ANY BREACH OF A FUNDAMENTAL TERM OR ANY NEGLIGENCE BY SHAW, YOUR EXCLUSIVE REMEDY SHALL BE TO RECEIVE FROM SHAW PAYMENT FOR ACTUAL AND DIRECT DAMAGES TO A MAXIMUM AMOUNT EQUAL TO THE FEES PAID BY YOU TO SHAW IN THE PAST THREE MONTHS FOR THE SERVICES.
  2. UNDER NO CIRCUMSTANCES SHALL SHAW BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS AND LOSS OF BUSINESS OPPORTUNITIES, THAT RESULT IN ANY WAY FROM THESE TERMS OF SERVICE, INCLUDING YOUR USE OF THE RENTAL EQUIPMENT AND/OR SERVICES, OR YOUR RELIANCE ON OR USE OF ANY INFORMATION, SERVICE, MERCHANDISE OR MATERIAL VIEWED OR PROVIDED ON OR THROUGH USE OF THE SERVICES, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN RECEPTION OR TRANSMISSION OR TRANSMISSION, OR FAILURE OF PERFORMANCE OF THE SERVICES.
  3. SHAW SHALL NOT BE LIABLE FOR, AND YOU SHALL INDEMNIFY AND SAVE SHAW HARMLESS FROM AND AGAINST ALL SUITS, CLAIMS OR JUDGMENTS HOWSOEVER ARISING OUT OF ANY OF THE FOLLOWING;
     1. CLAIMS FOR LIBEL, SLANDER, INFRINGEMENT OF COPYRIGHT, TRADEMARK OR OTHER INTELLECTUAL PROPERTY RIGHTS OR CONTRACTUAL RIGHTS OF ANY THIRD PARTY OR BASED ON ANY OTHER LEGAL THEORY HOWSOEVER ARISING FROM THE MATERIAL, DATA OR OTHER CONTENT FROM THE SERVICES;
     2. ANY LOSSES, DAMAGES, EXPENSES OR COSTS (INCLUDING LEGAL FEES) ARISING OUT OF OR IN CONNECTION WITH ANY CLAIM, OR OTHER PROCEEDING BASED ON A CONTENTION THAT THE USE OF THE RENTAL EQUIPMENT AND/OR THE SERVICES BY YOU OR A THIRD PARTY INFRINGES ANY INTELLECTUAL PROPERTY RIGHTS OR CONTRACTUAL RIGHTS OF ANY THIRD PARTY; OR
     3. CLAIMS BY THOSE TO WHOM YOU PROVIDE ACCESS TO THE RENTAL EQUIPMENT AND/OR THE SERVICES.
      
  4. FOR THE PURPOSES OF THIS SECTION 12, ANY REFERENCE TO "SHAW" SHALL INCLUDE SHAW, ITS PARTNERS OR ASSOCIATES, OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS.

   
• Limited Warranty
  ALL RENTAL EQUIPMENT AND THE SERVICES ARE PROVIDED BY SHAW "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND. SHAW DOES NOT WARRANT UNINTERRUPTED USE OR OPERATION OF THE RENTAL EQUIPMENT AND/OR THE SERVICES. SHAW DOES NOT WARRANT THAT ANY DATA OR COMMUNICATION SENT BY OR TO YOU WILL BE TRANSMITTED IN UNCORRUPTED FORM OR WITHIN A REASONABLE PERIOD OF TIME, OR THAT ANY CONTENT OR OTHER MATERIAL ACCESSIBLE ON OR FROM THE SERVICES ARE FREE OF DEFECT, ERROR OR VIRUSES. SHAW DOES NOT WARRANT THAT THE CONTENT, INCLUDING WITHOUT LIMITATION CONTENT OF ANY PROGRAMMING AND/OR ADVERTISING THAT IS ACCESSIBLE ON OR FROM THE SERVICES. ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF TITLE OR NONINFRINGEMENT, OR ANY IMPLIED REPRESENTATIONS, WARRANTIES AND CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABLE QUALITY WITH REGARD TO ANY MERCHANDISE, INFORMATION, PROGRAMMING, ADVERTISING, CONTENT OR SERVICE AND THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, ARE HEREBY EXCLUDED.
• Disputes and Governing Law
  1. ANY DISPUTES OR CLAIMS ("CLAIMS") WHATSOEVER BETWEEN SHAW AND YOU WILL BE REFERRED TO AND DETERMINED BY ARBITRATION TO THE EXCLUSION OF THE COURTS. IF YOU HAVE A CLAIM YOU SHOULD GIVE WRITTEN NOTICE TO ARBITRATE TO SHAW AT SUITE 900, 630 – 3RD AVENUE SW, CALGARY, AB T2P 4L4 ATTENTION: LEGAL DEPARTMENT. ARBITRATION WILL BE CONDUCTED BY ONE ARBITRATOR PURSUANT TO THE LAWS AND RULES RELATING TO COMMERCIAL ARBITRATION IN THE PROVINCE IN WHICH YOU RESIDE THAT ARE IN EFFECT ON THE DATE OF THE NOTICE. YOU AGREE TO WAIVE ANY RIGHT YOU MAY HAVE TO COMMENCE OR PARTICIPATE IN ANY CLASS ACTION AGAINST SHAW RELATED TO ANY CLAIM WHERE SUCH WAIVER IS PERMITTED. WHERE APPLICABLE. YOU ALSO AGREE TO OPT OUT OF ANY CLASS PROCEEDINGS AGAINST SHAW. IF SHAW HAS A CLAIM, SHAW WILL GIVE YOUR NOTICE TO ARBITRATE AT YOUR BILLING ADDRESS. IF THE CLAIM RELATES TO A MATTER THAT SHOULD BE BROUGHT BEFORE THE CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION (CRTC) OR OTHER CUSTOMER COMPLAINTS BODY SET UP TO ADDRESS SUCH MATTERS, YOU AGREE THAT THE CRTC OR SUCH BODY WILL RESOLVE THE CLAIM.
  2. THESE TERMS OF SERVICE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE PROVINCE IN WHICH YOUR BILLING ADDRESS IS LOCATED AND THE FEDERAL LAWS OF CANADA APPLICABLE THEREIN AND YOU HEREBY CONSENT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF SUCH JURISDICTION. THESE TERMS OF SERVICE CONSTITUTE THE ENTIRE UNDERSTANDING BETWEEN THE PARTIES WITH RESPECT TO THE SUBJECT MATTER OF THESE TERMS OF SERVICE AND SUPERCEDES AND REPLACES ANY AND ALL PRIOR WRITTEN OR VERBAL UNDERSTANDINGS.

   
• General
  1. You may not assign, resell or transfer the Rental Equipment or the Services to any person without prior written consent of Shaw. These Terms of Service will enure to the benefit of, and be binding upon, your respective heirs, executors, administrators, successors and permitted assignees and for the purpose of Shaw shall benefit to any party that controls, is controlled by or under common control with Shaw.
  2. Upon termination of these Terms of Service, all accrued obligations or liabilities and the provisions which by their nature are intended to continue beyond such termination will remain in effect. Without limiting the generality of the foregoing, the provisions of Sections 1, 2, 3, 4, 5, 11, 12, 13, 14, 16 and the terms of Shaw Acceptable Use Policy applicable to the Services you subscribed to shall survive the expiration and/or earlier termination of these Terms of Service.
  3. The failure of either party to insist upon strict interpretation of these Terms of Service or to exercise any options herein, shall not act as a waiver of any right or option, but the same shall continue to be in full force and effect. No waiver by either party of any breach shall be effective unless expressed in writing.
  4. Shaw does not grant you any right to use Shaw's logos, trademarks or trade names in any manner unless Shaw give you prior written consent and/or grants you an appropriate license to use.

  Shaw may disclose any information as is necessary to:

  1. satisfy any legal, regulatory or other governmental request;
  2. operate the Services properly;
  3. or protect Shaw or its customers, in accordance with the guidelines set out in Shaw's Privacy Policy.

• Terms of Payment
  The services you subscribe to are payable by the due date indicated on your bill. Payments made after the statement date on your bill will be reflected on your next bill. Amounts owing after the due date are subject to a late payment interest charge calculated on the outstanding amount at 2% per month (26.8% per year) until paid in full. If your account remains unpaid for 60 days you agree to pay a processing fee of $20.00 for services relating to down-grading or terminating your services. Overdue accounts are subject to termination of the services by Shaw. You agree to pay Shaw $25.00 if your credit card is denied or if your cheque is returned due to non-sufficient funds. Should it become necessary to disconnect a past due account, payment of the full outstanding balance plus a reconnection charge will be required before service is restored, provided Shaw is not under any obligation to restore the services to any person who continues to fail to make timely payment of the amounts due.

  By using Shaw's Internet Services and such services(collectively, the "Services") provided by Shaw Cablesystems G.P., its partners and associates (collectively, "Shaw"), you agree to the following terms of this Acceptable Use Policy, including the General terms contained below:

  This Acceptable Use Policy constitutes the agreement between Shaw ("Shaw" or "our") and the customer ("you" or" your") subscribing to the Services. This Acceptable Use Policy governs your use of the Services and any devices and/or equipment used to support the Services, including without limitation, a cable modem and software used in conjunction with the Services which is loaned to you from Shaw for your use solely in connection with the Services (collectively, the "Equipment"). By activating the Services, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with terms and conditions of Shaw's Terms of Services (collectively, the "Agreement"). If you do not wish to be bound by this Agreement or any modifications, which may be made by Shaw from time to time (as described in the following paragraph), do not activate or use the Services and immediately contact Shaw.

  Shaw may revise this Agreement and provide notice of such material changes to you by sending you an electronic mail message at your Shaw email address. Such changes shall be deemed effective upon the electronic communication being retrievable by you. YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION SENT TO YOU AND POSTED ONLINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICES AFTER YOU ARE NOTIFIED OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY SUCH CHANGES. • About Shaw Internet

  Shaw provides a variety of Internet Services to residences and businesses. The Shaw High-SpeedLite Internet™, Shaw High-Speed Internet™, Shaw High-Speed Extreme™, Shaw High-Speed Warp™ and Shaw High-Speed Nitro™ Internet Services allow residential customers to connect to the Shaw high-speed backbone network, and the Internet. Shaw Point of Sale Connect, High-Speed Extreme, and Business High-Speed Internetallow businesses to connect to the Shaw high-speed backbone network, and the Internet for the purposes of transacting business.
  
  The Services use resources that are shared with many customers. Moreover, the Services provide access to the Internet which is used by millions of others. Each user benefits by being able to share resources and communicate almost effortlessly with other members of the user community. However, as with any community, the benefits and privileges available from the Services, and the Internet in general, must be balanced with duties and responsibilities designed to guarantee uniform access to all customers of the Services.
  
  Use of the Services is subject to the following rules and guidelines. You are responsible for ensuring that the use of all Services provided to you comply with this Agreement.

• Illegal Activity

  Use of the Services for any activity that violates Local, Provincial, Federal or International law, order or regulation, is a violation of this Agreement. Prohibited activities include, but are not limited to:

  1. Posting, storing, transmitting or disseminating unlawful material, including without limitation, child or other pornography, any content, data or othermaterial which is libelous, obscene, hateful, unlawful, threatening, reaction or ethnically offensive, defamatory or which in any way constitute or encourages conductthat would constitute a criminal offense.
  2. Disseminating material which violates copyright or intellectual property rights. The customer assumes all risk regarding whether material is in the public domain;
  3. Pyramid or other illegal soliciting schemes; or
  4. Fraudulent activities; including but not limited to: impersonating any person or entity, or forging anyone's digital or manual signature.

   
• Security

  You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services.
  
  The Services may not be used to breach the security of another user, or to attempt access to anyone's computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools is strictly prohibited.
  
  YOU MAY NOT DISRUPT THE SERVICES. The Services also may not be used to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to crash a host. The transmission or dissemination of any information or software which contains a virus or other harmful feature is also strictly prohibited.
  
  YOU ARE RESPONSIBLE FOR THE SECURITY OF ANY DEVICE YOU CONNECT TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, DATA STORED ON THAT DEVICE. In particular, Shaw recommends against enabling file or printer sharing of any kind. Shaw recommends that any files or services you make available for remote access be password protected.

• Inappropriate Content

  Shaw is not responsible for any content you post, store, transmit, disseminate or access through use of the Services. Any content questions or complaints you may have regarding content you accessshould be addressed to the content provider.
  
  You are responsible for information published to the Web or other Internet services, through your account. Shaw reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it, at its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful.
  
  Shaw has no obligation to monitor transmissions made on the Services. However, Shaw has the right to monitor such transmissions and to disclose the same in accordance with Shaw's Privacy Policy. By using the Services to publish, transmit or distribute content, a user is warranting that the content complies with this Agreement and licenses and authorizes Shaw to reproduce, publish, distribute and display such content worldwide.

• Electronic Mail

  Shaw limits the number of email messages that you can send through the Services using Shaw's email servers in a 24 hour day. Shaw defines an email message as one message sent to one recipient. For example: a single message addressed to three recipient email addresses would count as three email messages. Shaw High-Speed Internet, High-Speed Lite Internet, High Speed Extreme Internet,High Speed Warp Internet and High-Speed Nitro Internet are limited to 1000email messages per 24 hour day and no single email message can be addressed to more than 99 recipient email addresses. ShawHigh-Speed Internet, ExtremeInternet, and Business Internet are limited to 1000 email messages per 24 hour day and no single email message can be addressed to more than 400 recipient email addresses.
  
  The Services may not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages may be sent only to those who have explicitly requested them.
  
  The Services may not be used to collect responses from unsolicited email sent from accounts on other Internet hosts or email services which violates this Agreement or the acceptable use policy of any other Internet service provider. Moreover, unsolicited email may not direct the recipient to any Web site or other resource which uses the Services.
  
  Forging, altering or removing electronic mail headers is prohibited. However, you may insert additional characters into your from: and reply-to: addresses in order to prevent your true address from being automatically added to the mailing lists used by bulk emailers. In this case, your true address must remain obvious to any human viewer. For example, you may substitute nospam.john.smith for john.smith.
  
  You may not reference Shaw, Shaw Lite-Speed Internet or Shaw High-Speed Internet (e.g. including Organization: Shaw High-Speed Internet in the header, or by listing an IP address that belongs to Shaw) in any unsolicited email, even if that email is not sent through Shaw. Shaw owns all IP addresses and email usernames for all Services.
  
  Mail Bombing is prohibited. You may not send numerous copies of the same or substantially similar messages, nor may you send very large messages or files to a recipient with the intent to disrupt a server or account. The propagation of chain letters is prohibited, whether or not the recipient wishes to receive such mailings.
  
  Shaw is not responsible for the forwarding of email sent to any account which has been suspended or terminated. Such email will either be returned to sender, ignored, deleted, or stored temporarily, at Shaw's sole discretion.

• Newsgroups

  Messages posted to newsgroups must comply with the written charters or Frequently Asked Questions ("FAQs") for those newsgroups. Advertisements, solicitations, or other commercial messages may be posted only in those newsgroups whose charters or FAQs explicitly permit them. You are responsible for determining the policies of a given newsgroup before posting to it.
  
  Posting or cross-posting the same or substantially similar messages to more than 9 newsgroups is prohibited. Our news software will automatically cancel any messages posted to 9 or more newsgroups.
  
  Binary files may not be posted to newsgroups not specifically named for that purpose.
  
  Forging, altering or removing header information is prohibited. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.
  
  Shaw reserves the right to discontinue access to any Usenet newsgroup at any time and for any reason.
  
  You may not flood or disrupt Usenet newsgroups. Disruption is defined as posting a large number of messages to a newsgroup which contain no substantive content, to the extent that normal discussion in the group is significantly hindered. Examples of disruptive activities include, but are not limited to: posting multiple messages with no text in the body, posting many follow-ups to messages with no new text.
  
  Messages may not be cancelled, except by the author or by official newsgroup moderators performing their duties.
  
  The Usenet news service included with a Shaw account is provided for interactive use by you, using a commonly-available NNTP client such as NETSCAPE COMMUNICATOR or OUTLOOK EXPRESS. Non-interactive clients that download Usenet articles in bulk are prohibited.

• Internet Relay Chat

  The Services may be used to participate in Chat discussions hosted by Shaw servers, third party servers, or may not involve servers at all. In all cases, Shaw does not monitor the contents of the discussion and is not liable for the content of any communications made via Internet Chat.
  
  The Services may not be used for Chat flooding. Flooding is defined as deliberately repeating actions in quick succession in order to fill the screens of other Internet users with text.
  
  Any computer or other device connected through the Services may not maintain more than 2 simultaneous chat connections. This includes the use of automated programs, such as bots or clones. Automated programs may not be used when the account holder is not physically present at the device.
  
  The Services may not be used to send messages which disrupt another Internet user's equipment, including software, hardware and user display. The Services may not be used to access any chat server in violation of this Agreement of that server. The Services may not be used to manipulate any chat server in order to harass or disconnect other Internet users, or to gain privileges which have not been authorized.
  
  You are not permitted to use the Services to connect to chat servers or channels from which you have been banned.
  
  The Services may not be used to continue to send chat messages to an Internet user who has indicated their desire to not receive messages.

• Bandwidth, Data Storage and Other Limitation

  You must comply with the current bandwidth, data storage and other limitations on the Services.
  
  You must ensure that your activity while using the Services does not improperly restrict, inhibit or degrade any other customer's use of the Services, nor represent (in the sole judgment of Shaw) an unusually large burden on the network itself, such as, but not limited to, peer to peer file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. The guidelines for Bandwidth Usage/month for each service package are the following: Shaw High-Speed Lite, 30 gigabytes; Shaw High-Speed Express, 60 gigabytes; Shaw High-Speed, 125 gigabytes; Shaw Extreme, 250 gigabytes; Shaw Warp, 400 gigabytes; Shaw Nitro, 500 gigabytes; Broadband 50, 400 gigabytes; Broadband 100, 500 gigabytes; Broadband 100+, 750 gigabytes; Unlimited Lite, unlimited data; Unlimited Express, unlimited data; Unlimited 100, unlimited data; Point of Sale Connect, 10 gigabytes; Server Connect, 200 gigabytes; Business Internet 25, 110 gigabytes; Business Internet High-Speed, 70 gigabytes; Business Internet Starter, 125 gigabytes; Business Internet 25, 250 gigabytes; Business Internet 50, 500 gigabytes; Business Internet 50 Plus, 750 gigabytes; Business Internet 100 Plus, 1 terabyte (all bandwidth is based on combined download and upload). The guidelines for acceptable website traffic include two gigabyte/month for High-Speed, Extreme and Business hosting packages. Shaw reserves the right to set specific limits for Bandwidth Usage and charge for excessive Bandwidth Usage for residential Services at any time. In addition, you must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede Shaw's ability to deliver the Services and monitor the Services, backbone, network nodes and/or other network services.
  
  UNDER NO CIRCUMSTANCES WHATSOEVER ARE YOU PERMITTED TO RESELL, SHARE, OR OTHERWISE DISTRIBUTE THE SERVICES OR ANY PORTION THEREOF TO ANY THIRD PARTY WITHOUT THE WRITTEN CONSENT OF SHAW AND PAYMENT OF APPLICABLE FEES. For example, you cannot provide Internet access to others through a dialup connection, host shell accounts over the Internet, provide email or news service, or send a news feed unless express permission is granted by the customer agreement.
  
  The residential Shaw Services are designed for personal Internet use. You may not use the residential Shaw Services for commercial purposes. You may not run a server in connection with the Shaw Services nor may you provide network services to others via the Shaw Services. Examples of prohibited servers and services include but are not limited to mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. Some business services may be exempt from these limitations.

• Traffic Management Policies

  Shaw uses traffic management policies to ensure proportional access to its network for all Shaw Internet customers. Some Peer-to-Peer (P2P) applications used for non real-time file sharing can consume a disproportionate amount of upstream bandwidth causing disruption to other customers on Shaw's network. Shaw's traffic management policies were introduced to quickly address any upstream congestion caused by these P2P applications while standard network expansion activities are undertaken to increase the bandwidth availability for all users.

  Shaw's traffic management policies come into effect only if upstream network congestion occurs on a network segment. If congestion occurs, the traffic management policies reduce the amount of upstream bandwidth available for P2P applications completing non real-time file transfer activity to 80 kbps per end-user.

  Shaw's traffic management policies do not affect download speeds and will not affect real-time interactive activities such as on-line gaming, banking, e-mail or VoIP services. For the majority of Shaw customers the Internet experience is unaffected by our traffic management policies and both upstream and downstream bandwidth will be available to ensure the full operation of any application.

  The traffic management policies implemented by Shaw use IP addresses to make real-time traffic management decisions in relation to Shaw's network. Since IP addresses have the potential to be linked to an individual's customer account, IP addresses could be considered personal information. The traffic management policies implemented by Shaw do not involve capturing, storing or archiving this information in any way.

• Violation of this Agreement

  Shaw does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, Shaw will respond appropriately if it becomes aware of inappropriate use of the Services. Although Shaw has no obligation to monitor the Services and/or the network, Shaw reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and Shaw Internet customers.
  
  Shaw prefers to advise customers of inappropriate behaviour and any necessary corrective action. However, if you use the Services in a way which Shaw, in its sole discretion, believes violate this Agreement, Shaw may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. Shaw will not have any liability for any such responsive actions. The above described actions are not Shaw's exclusive remedies and Shaw may take any other legal or technical action it deems appropriate.
  
  Shaw reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on Shaw's servers and network. During an investigation, Shaw may suspend the account or accounts involved and/or remove material which potentially violates this Agreement.
  
  You hereby authorize Shaw to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include Shaw providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in Shaw's Privacy Policy.
  
  Upon termination of your account, Shaw is authorized to delete any files, programs, data and email messages associated with such account.
  
  The failure of Shaw to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time.
  
  You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.

• General

  1. Customer Computer It is your responsibility to ensure that your computer equipment meets the requirements set out by Shaw as may be amended from time to time, that are necessary to use the Services.
  2. Relocating Cable Modem You agree not to relocate Shaw's cable modem within your premises without notifying Shaw, so that Shaw may schedule a mutually agreeable time to undertake such work.
  3. Personal Pages You may create personal pages on our World Wide Web Server (the "Site"). On the Site, you can conceive, design, create, maintain, and publish texts, diagrams, illustrations, audio clips and related materials for access by a global audience. You warrant that the content on your Site is suitable for publication, is not libelous or defamatory, does not breach the intellectual property rights (including, without limitation, copyright) of any third party, and complies with all laws, regulations, court orders and other legal requirements. While it is your responsibility to regulate and control all content on the Site, Shaw may decide to suspend or delete your home page without your consent if you violate this Agreement. In addition, if Shaw determined that it is appropriate, Shaw may either. i) issue a warning to you; ii) suspend your access to some or all of the Services; or iii) terminate this Agreement, inclusive of your access and use of the Services.
  4. Ownership of Addresses Shaw owns all addresses provided to you, including but not limited to IP addresses, e-mail addresses and personal Web page addresses. SHAW MAY MODIFY OR CHANGE SUCH ADDRESSES AT ANY POINT IN TIME AND SHALL IN NO WAY BE REQUIRED TO COMPENSATE YOU FOR SUCH CHANGES.
  5. End User Licenses You agree to comply with the applicable terms and conditions of all end user license agreements accompanying any software or plug-ins to such software distributed in connection with the Service. All such end user licenses will terminate upon termination of this Agreement. In the event of an inconsistency between the terms of this Agreement and any such license, the terms of this Agreement shall prevail.
  6. Multiple Users You acknowledge that you are executing this Agreement on behalf of all persons who use the Services through your computer. You assume all liability for such use of the Services and are responsible for ensuring that all such other users understand and comply with the terms and conditions of this Agreement.
  7. No License; Intellectual Property of Shaw and Others Nothing within the Services or any additional services offered by Shaw from time to time or through any Shaw Web site shall be construed as conferring any license of Shaw's or any third parties' intellectual property rights, whether by estoppel, implication, waiver, or otherwise. You acknowledge and agree that Shaw's Web sites, the Services and/or additional services offered by Shaw from time to time are protected by copyright, trademark, patent, or other proprietary rights. No portion of the Services or Shaw's Web sites are affiliated with or endorsed by Microsoft, America Online or ICQ Inc. The mark MSN Messenger is owned by Microsoft; the mark Instant Messenger and AOL Instant Messenger are service marks of America Online; the mark ICQ is a registered mark of ICQ Inc.; other marks not identified herein are the property of their respective owners. By usingMSN Messenger, Instant Messenger and AOL Instant Messenger or any other third party software you accept all responsibility for obtaining licensing grants and permission to connect to MSN Messenger, AIM and ICQ Networks directly from the applicable third party service provider. You agree not to defame or disparage Shaw, the trademarks or service marks of Shaw as shown below or as may be amended from time to time. Shaw marks:

  These terms and conditions are in addition to Shaw's Joint Terms of Service.
  
  By using Shaw's Phone Service and such other services related thereto (collectively, the "Service") provided by Shaw Telecom G.P. or its partners and/or associates (collectively, "Shaw"), whether you are a residential phone subscriber ("Residential Phone") or small business/home office phone ("Business Phone") subscriber, you agree to the following terms of this Acceptable Use Policy:
  
  This Acceptable Use Policy constitutes the agreement between Shaw ("Shaw" or "our") and the customer ("you" or" your") subscribing to the Service. This Acceptable Use Policy governs your use of the Service and any devices and/or equipment used to support the Service, including without limitation, a telephone adapter and software used in conjunction with the Service which is loaned to you from Shaw for your use solely in connection with the Service (collectively, the "Equipment"). By activating the Service, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with the terms and conditions of Shaw's Terms of Services and Privacy Policy (collectively, the "Agreement"). If you do not wish to be bound by this Agreement or any modifications, which may be made by Shaw from time to time (as described in the following paragraph), do not activate or use the Service and immediately contact Shaw.
  
  Shaw may change portions of this Agreement from time to time upon reasonable notice to you. Shaw will post notice of any changes made to the Agreement on line at Shaw.ca by setting the last date of revision on the top right hand corner. Shaw may also advise you of such changes by sending you an electronic mail message at your user address or mailing notification through Canada post to the address shown on your account with Shaw. All changes will take effect within 30 days of the date of being posted. If you do not have access to the Internet you may contact Shaw at any time to obtain a printed copy of this Agreement. YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION POSTED ONLINE OR SUPPLIED TO YOU BY SHAW TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICE AFTER CHANGES ARE POSTED CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY THE POSTED CHANGES.
• Uses and Restrictions
  1. Shaw Residential Phone Service (Home Phone, Home Phone Lite, Home Phone Basic, or as may be further branded by Shaw from time to time): You may only use the Service from your phone(s) located at your residence. The Services are required to be connected to Shaw's Equipment and used only for normal residential calling purposes such as person to person conversations or voice messages..
     
     You may not use the ShawHome Phone Service for:
     
     1. Non-residential use (example: the Service cannot be used to operate a business, including, without limitation a home based business whether or not the business is for profit or any other commercial purpose whatsoever);
     2. Data, fax, internet access, a call centre, call back, call sell (telemarketing), auto dialer, bulk faxing or debit card services;
     3. Illegal, fraudulent or improper purposes, criminal offences, intellectual property infringement, harassment (including annoying or offensive calls/transmissions); or
     4. Any purpose intended to cause interference with Shaw's network operations or the Services, including the fair and proportionate use of the Services by others, as determined by Shaw, in its sole discretion, from time to time.
     
     
     Additionally, you may not use the Shaw Residential Phone Service for:
     
     5. Chat lines, multi-party lines, long-distance calls made using call forwarding and three-way calling features, multi-party conference calls, free conference calling services, or party lines or calls to pay-per-call services which impose unusually high costs on Shaw; or
     6. Sustained and excessive use of the Service in a manner which is materially inconsistent with average residential usage patterns to make unlimited long distance calls directed to or within certain high cost of service areas, as determined and designated as such by Shaw, in its sole discretion, from time to time.
      
  2. Shaw Business Phone:You may only use the Service from your phone(s) located either at your small office or at the home office within your residence. The Services are required to be connected to Shaw's Equipment and used only for normal business calling purposes such as person to person conversations or voice messages.
     
     You may not use the Shaw Business Phone Service for:
     
     1. Data, fax, internet access, a call centre, call back, call sell (telemarketing), auto dialer, bulk faxing or debit card services;
     2. Illegal, fraudulent or improper purposes, criminal offences, intellectual property infringement, harassment (including annoying or offensive calls/transmissions); or
     3. (c) Any purpose intended to cause interference with Shaw's network operations or the Services, including the fair and proportionate use of the Services by others, as determined by Shaw, in its sole discretion, from time to time.
     
     
     Additionally, you may not use the Shaw Business Phone Service for:
     
     4. Chat lines, multi-party lines, long-distance calls made using call forwarding and three-way calling features, multi-party conference calls, free conference calling services, or party lines or calls to pay-per-call services which impose unusually high costs on Shaw; or
     5. Sustained and excessive use of the Service in a manner which is materially inconsistent with average small home office/business usage patterns to make unlimited long distance calls directed to or within certain high cost of service areas, as determined and designated as such by Shaw, in its sole discretion, from time to time.
     
     
     

     You are solely responsible for the use of the Residential Phone or Business Phone Services by you and other users, including all calls originating from your telephone(s), as well as for all charged calls accepted at your telephone(s), regardless of who made or accepted them. You agree that any unlimited long-distance calling available on your Service is only available for calls within Canada and to the U.S., with the exception for calls made in and to NWT area code 867, Hawaii area code 808, and Alaska area code 907, or such other calling areas as identified and designated by Shaw on its website, in its sole discretion, from time to time. You also agree that calls to multi-party conference services, party lines, adult services, or to high cost pay-per-call services may be restricted by Shaw, it its sole discretion, from time to time. Calls terminating outside of the applicable calling area for your Service, as identified and designated by Shaw in its sole discretion from time to time, are subject to higher rates. YOU ARE REQUIRED TO CONTACT SHAW BEFORE YOU USE ANY MEDICAL MONITORING DEVICES THROUGH THE SERVICE. Other restrictions may apply to the Service and a Shaw representative will advise you of those, if any, at the time you subscribe to the Service.
     
     You agree to: (a) take all necessary measures to ensure that the Shaw Phone Services are used in accordance with this Agreement; and (b) be liable for all consequences resulting from any breach of this Agreement. Your abuse or misuse of all or any part of the Service or breach of any term contained in this Agreement may cause all or any part of the Service to be restricted, blocked, suspended, downgraded or terminated by Shaw (refer to Shaw's Terms of Service for details regarding termination of the Service). Shaw may also refuse, at any time and without liability, to provide any of the Services to you where Shaw would have to incur unusual expenses such as, but not limited to, the payment of high costs to other telecommunication carriers. Shaw may, but shall not be obligated to provide such Services if, upon Shaw's request and agreement, you agree to pay an amount for these unusual expenses. Agreements on such matters shall be in writing and signed by you and Shaw.

   
• Service Interruptions
  Shaw does not warrant uninterrupted use of the Service. You understand that it is your responsibility to ensure that the telephone(s) you use with the Service are compatible with the Equipment. Most importantly, some telephone(s) may not operate if there is a power failure and if you are using a telephone that requires power to operate you would lose your ability to use the Service, including access to 9-1-1 emergency services until the power is restored. In addition, and in accordance with the Terms of Service, a power failure or disruption in the Service may require Shaw to reset or reconfigure the Equipment prior to you utilizing the Service.
• Re-Sold Service
  Where re-sold telephone service is being provided to you by Shaw as all or part of the Service:
  

  1. maintenance for the local and long distance telephone service may be provided by parties other than Shaw; and
  2. all local and long distance telephone services may be subject to the terms and conditions imposed by the primary service provider (including applicable tariffs) with respect to the Service. Shaw reserves the right to transfer re-sold local phone service as a Shaw local service.

   
• Automatic-Dialing Announcing Devices
  Shaw enforces all Canadian Radio-television and Telecommunications Commission rules on Automatic - Dialing Announcing Devices ("ADAD") and unsolicited voice and facsimile calls made for the purposes of solicitation. The use of ADAD to make unsolicited calls for the purposes of solicitation, used to place calls to emergency lines or healthcare facilities is strictly prohibited. If you violate these restrictions or those posted by the Canadian Radio-television and Telecommunications Commission Shaw may terminate the Service immediately.
• Directory Service
  1. Your name, address and telephone numbers will be published in the telephone directory for your area. Unless you contact Shaw to advise you do not wish your information to be published in the telephone directory.
  2. In the case of errors or omissions in your, name, address and telephone number in the directory listings, whether or not the error or omission is with regard to telephone numbers, addresses, individual names or business names, Shaw is only responsible to provide you a refund or credit of any charges associated with the listings in question for the period during which the error or omission occurred.

   
• Provision of 9-1-1 Access
  1. You may use the Service to receive access to emergency services through the 9-1-1 service provider. The emergency 9-1-1 fee charged by the Municipality may be billed by Shaw each month as part of your monthly charge for the Service or may be billed directly to you by the Municipality.
  2. If there is a suspension or termination of the Service, including as a result of a power failure, all features of the Service, including emergency 9-1-1 service, may be suspended or terminated.

   
• Hearing Impaired Assistance
  1. You will have access to Hearing Impaired Assistance services through the Service to assist you in placing calls, to or from persons who use a telecommunications device for the deaf ("TDD") machine or a text based form of message relay service using the Internet ("IP Relay Service"). Hearing Impaired Assistance operators will be available to assist you in making calls to deaf, hard-of-hearing, and speech impaired customers by relaying messages between TDD / IP Relay Service users and conventional phone users. Long distance charges will apply where applicable.
  2. In order to use IP Relay Services you must first register with Shaw's IP Relay Services Web Site. You will also need to be resident in an area where Shaw offers the service, have an Internet access service, and provide compatible end user equipment for use with the IP Relay Services.
  3. The IP Relay Services is for individual use only, and does not permit you to place collect call, 900 pay-per-call, bill to third party, casual calls and calls to satellite phones using the IP Relay Service and to any other types of calls, which Shaw notifies you as being prohibited, from time to time.
  4. The IP Relay Service is not designed for emergency calls, nor should it be used as a substitute for enhanced 9-1- 1 services. Should you utilize the IP Relay Services to make a call to the 9-1-1 services, you acknowledge and agree that:
     
     1. In regard to a call to the emergency telephone number (9-1-1), use of the IP Relay Services may result in account address information being delivered to the emergency services dispatch centre via the IP relay provider's network;
     2. The use of the account address information in association with the IP Relay Service could result in calls appearing to originate from a location other than your current location;
     3. If, in dispatching the emergency services in response to a call to 9-1-1, reliance is placed on the address information associated with your Shaw account and received by the IP relay provider's network in conjunction with the call to 9-1-1, emergency services may not be routed to the location from which the call to 9-1-1 originated;
     4. In regard to a call to 9-1-1, you or any person using the IP Relay Services is responsible to provide complete and accurate information relating to the actual location of the emergency situation to the emergency services call operator; and
     5. Without restricting any indemnities set forth in Shaw's Joint Terms of Service, you are responsible and shall indemnify Shaw for, and hold Shaw harmless from and against, all charges, losses, costs, liabilities and damages of any kind whatsoever related to emergency services being dispatched to a location other than the location from which the call to 9-1-1 originated as a result of:
        
        1. Any use by you of the IP Relay Services that results in the address information for your Shaw account being a location other than the location from which the call to 9-1-1 originated; or
        2. The failure by you or any person using the IP Relay Services or any services used in conjunction with the IP Relay Services to respond, or provide complete or accurate information, to a 9-1-1 or emergency call operator requesting a response or information in order to properly dispatch emergency services; or
        3. The failure by you to provide Shaw with current and accurate information location; or
        4. Any use by of the IP Relay Services after cancellation, termination or suspension of your Shaw phone services.
         
      

   
• Ownership of Numbers
  Shaw owns all numbers provided to you including all telephone numbers and calling card numbers. Shaw may be required to modify or change such numbers at any point in time and will in no way be obligated to compensate you for such changes.
• Security Codes
  You are responsible to maintain the confidentiality of any security codes to your voice mail or other accounts.
• Equipment Installation, Maintenance and Return Responsibilities
  1. Shaw will install the Equipment within your home. The Equipment will be supplied to you by Shaw solely for your use of the Service and will at all times remain the property of Shaw. You may use the Equipment only at the address you have indicated to Shaw at the time you subscribe to the Service. You are responsible to advise Shaw if your address is changing. If you move to a location outside of the area served by Shaw, this Agreement shall be terminated and you must return to Shaw all Equipment. Kindly refer to the Terms of Services for complete details regarding your obligations as they pertain to Shaw Equipment.
  2. You are responsible to supply at your cost all telephones required for your use of the Service, including without limitation, the supply of all medical and security monitoring devices, fax, including the wiring inside your home which is required to connect to the Service. Shaw has no obligation to maintain or repair any facilities or equipment owned by you. You are responsible to maintain your own equipment at your own cost. Shaw is not responsible if your equipment is not compatible with the Equipment or the Service or if your equipment interrupts or causes interference with the Service or if it causes the Service to fail for any reason whatsoever.

   
• If You are Moving
  If you move premises within Shaw's serving area and you wish to transfer the Service, including your current telephone number, to the new premises, you must give Shaw a minimum of fifteen (15) calendar days advance notice by calling our Customer Service Department at 1-888-472-2222 or your local Shaw branch at the address shown in the Contact Us section of our Web site Shaw.ca. You may only transfer your telephone number within the same exchange area. The ability to transfer the Service to the new premises is dependant on the availability of the Service at the new location. If sufficient advance notice is not received, Shaw may not be able to provide the Service on the date of your relocation.
• Confidentiality

  Shaw may disclose any information as is necessary to:
   

  1. satisfy any legal, regulatory or other governmental request;
  2. operate the Service properly; or
  3. protect Shaw or its customers, in accordance with the guidelines set out in Shaw's Privacy Policy;

   

  For the purpose of the Service, Shaw may be required to disclose your name, address and listed telephone number to: - another telephone company, provided the information is required for the efficient and cost-effective provision of telephone service and disclosure is made on a confidential basis with the information to be used only for that purpose; - a company involved in supplying you with telephone or telephone directory related services, provided the information is required for that purpose and disclosure is made on a confidential basis with the information to be used only for that purpose; or - an agent retained by Shaw in the collection of your account, provided the information is required for and is to be used only for that purpose.
  
  As part of the Service, Shaw offers privacy enhancing features such as Call Display, Call Display Block, Last Call Return and Call Trace. For more information on these features please contact our Customer Service Department at 1-888-472-2222.

Terms of Use - Shaw Go WiFi

  By accessing and using the Shaw Internet WiFi ("Shaw Go WiFi") provided by any of Shaw Cablesystems G.P., Shaw Telecom G.P. or its or their partners and/or associates (collectively, "Shaw"), you agree to the following terms and conditions of service, which incorporate by reference the Shaw Joint Terms of Use, Shaw Acceptable Use Policy, and Shaw Privacy Policy terms and conditions available at www.shaw.ca (collectively, the "Terms of Use ").
  
  You agree that Shaw may, for any reason, and without notice to you, modify or terminate Shaw Go WiFi and these Terms of Use without liability to you, any user or any third party. If you do not wish to be bound by these Terms of Use or any modifications which may be made by Shaw from time to time, do not access or use Shaw Go WiFi and immediately contact Shaw.
  
  YOUR NONTERMINATION OR CONTINUED USE OF SHAW GO WIFI AFTER THE EFFECTIVE DATE OF ANY CHANGES MADE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF USE AS MODIFIED BY SUCH CHANGES.

• Access to and Use of Shaw Go WiFi
  You understand that Shaw Go WiFi is a feature of Shaw's Internet service and that you must be a current subscriber to a Shaw Internet service in order to use Shaw Go WiFi. As with other Shaw services, you are permitted to use Shaw Go WiFi only for lawful purposes. Your data usage under Shaw Go WiFi will be included as part of your internet package's data allowance.
  
  In order to access Shaw Go WiFi, you must provide your Shaw userid, password and certain other information ("Shaw Go WiFi ID") that may be requested from time to time. Shaw may also automatically collect certain information, such as MAC address, device location and device type, in order to provide you services and improve your service experience. You acknowledge and agree that you will be responsible for all activities during any session using Shaw Go WiFi under your Shaw Go WiFi ID. You may not provide any third party with your Shaw Go WiFi ID for the purpose of accessing Shaw Go WiFi. You remain responsible for all bandwidth usage incurred utilizing your Shaw Go WiFi ID as well as any account changes that may be imposed as a result of your bandwidth usage as set out in the Terms of Use, and agree to pay any applicable fees charged to your account for the use of Shaw Go WiFi, plus any applicable taxes and other fees imposed as a result of these Terms of Use.
  
  You may use Shaw Go WiFi solely for your own lawful personal purposes. You may not in any way distribute, resell or otherwise provide third parties with access to or use of Shaw Go WiFi.
• Performance of Shaw Go WiFi
  In order to use Shaw Go WiFi, you must have a Wi-Fi capable device that:
  
  

  1. meets Canadian and other applicable technical standards;
  2. is compatible with Shaw Go WiFi;
  3. renders web pages in a standard HTML browser application;
  4. runs the IP protocol; and
  5. is configured to obtain IP addresses automatically.

  
  The Wi-Fi device must be in close enough proximity to Shaw Go WiFi wireless access points to achieve connectivity with the Shaw Go WiFi network. Shaw Go WiFi access location lists and maps may be updated from time-to-time. Actual Shaw Go WiFi coverage, locations and quality may vary.
  
  Shaw will endeavour to provide useful and reliable Shaw Go WiFi services, but you acknowledge that Shaw Go WiFi utilizes public, unlicensed radio-frequency spectrum. As such, Shaw Go WiFi is subject to external interferences, environmental influences, and other factors and variables beyond Shaw's reasonable control. Performance and availability may vary, including but not limited to or affected by,
  
  

  1. transmission and download speed and accuracy;
  2. network congestion;
  3. performance, configuration, and functionality of your Wi-Fi devices and wireless cards (including, but not limited to memory, storage and other limitations);
  4. physical obstructions and distances between your WiFi device and the Shaw Go WiFi network;
  5. availability of electric power;
  6. collocation failures;
  7. transmission and equipment limitations, failures, maintenance or repair; and
  8. user error.

  
  Shaw Go WiFi may also be interrupted, refused, limited or curtailed for these reasons. Shaw is not responsible for data lost or misdirected due to these and other foreseeable and unforeseeable factors. Network speed is an estimate and is no indication of the speed at which your Wi-Fi device or Shaw Go WiFi will operate. Actual network speed and other performance will vary.
  
  In order to maintain acceptable levels of service for all Shaw Go WiFi customers and to improve this service, Shaw reserves the right to monitor use of Shaw Go WiFi and to make such adjustments to the use of such services as necessary to maximize the benefit and enjoyment for all Shaw Go WiFi customers. Additionally, the Shaw Go WiFi service may use automated processes to monitor and scan communications over the Shaw Go WiFi network in order to maintain and provide services, improve your experience, ensure the integrity of your communications, convey messages related to your Shaw Go WiFi account, deliver relevant advertising and for various other purposes related to the provision of Shaw Go WiFi services. By using the Shaw Go WiFi service, you acknowledge and consent to Shaw's automated processing of your communications through the Shaw Go WiFi network, including information such as your IP or MAC address, Shaw Go WiFi ID, device location, HTTP requests and other information related to the provision of this service.
• Service Subject To Interception and Unauthorized Use
  You acknowledge that communications over the Shaw Go WiFi network may be subject to interception by unauthorized third parties. Although Shaw uses commercially reasonable efforts to provide you with a secure and reliable service, your use of Shaw Go WiFi is "AS IS" and "AS AVAILABLE" and Shaw cannot and does not make any general or specific warranties regarding the security, availability, performance or other functionality of Shaw Go WiFi. You are responsible for implementing your own security protections while using Shaw Go WiFi. In the event you become aware of any unauthorized use of Shaw Go WiFi or any other security breach (including but not limited to third-party use of your Shaw Go WiFi ID and password), you agree to immediately notify Shaw. Shaw expressly disclaims any responsibility or liability for your use of Shaw Go WiFi and for any lack of security that may result from your use of Shaw Go WiFi. You agree to hold Shaw harmless for the loss of any file, data or other information while using the Shaw Go WiFi services, and for any unauthorized access to or utilization by any third party of any of your personal, financial, or other sensitive information.
• Marketing and Shaw's Use of Wi-Fi Data
  You understand and agree that Shaw may from time to time use location or other data generated from your use of Shaw Go WiFi to deliver general or user specific messaging or advertising from Shaw or a third party to the browser you are using to access the Internet. Furthermore, you understand and agree that the Shaw Go WiFi "watermark" bearing Shaw's logo may appear superimposed from time to time over portions of website pages you visit, that the watermark is intended solely to identify Shaw Go WiFi as the source of your wireless Internet access service, and that this in no way indicates Shaw's approval of or responsibility for the content of such websites, which are solely the responsibility of the website operators and/or content providers. You agree that you will not seek to hold Shaw responsible in any way for any third party website content or the operation of any third party website accessed via Shaw Go WiFi, or for the appearance of our Shaw Go WiFi "watermark" over a portion of any website.
